Michael Jackson''s former lawyer is seeking $2 million (£1 million) in damages for being secretly recorded on a plane with the singer. Mark Geragos is suing charter firm XtraJet after he was taped with the singer in November 2003.
Mr Jackson was travelling to California to surrender to state police over child molestation charges.
In 2005, Xtrajet''s owners admitted planting two digital video recorders. But they denied any sound was taped.
Sentencing
Jackson, who was acquitted in 2005, has since dropped out of the legal battle.
In court on Wednesday, Geragos'' lawyer said $2m in damages was fair given that XtraJet''s owner offered to sell the tape up to that amount.
Company owner Jeffrey Borer was sentenced in October to six months of home detention and three years'' probation.
His co-defendant, Arvel Jett Reeves, was sentenced in July to eight months in prison with six additional months in a halfway house.
They were both fined for their involvement.
I can''t think of any act more distressing to me at a professional level than what was done here
Mark Geragos
In the most recent court battle Borer''s laywer said that no actual conversation was taped.
"From the very first day of this case they have known there was no sound involved," he said.
On Tuesday, Geragos claimed the taping one of the worst experiences of his 24-year legal career.
"I can''t think of any act more distressing to me at a professional level than what was done here," he said.
The judge deferred a decision to a later date.
