Junior Officers of the Third Battalion of Infantry in Sunyani have filed a writ at a Sunyani Magistrates court against two popular musicians Kwabena Kwabena and Krontihene and an agent Samuel Arkoh for failing to honour an agreement to perform at the soldiers end of year dance during last year’s Christmas.
The writ filed on December 4, 2006 by Corporal Opoku Charles on behalf of the Executive of the Junior Officers Mess is claiming ¢8 million from Arko of Space FM who collected the money for the artists for the programme which was dubbed "Nkaban Dance" 2005.
In a supporting affidavit, the executives claimed that around November 2005, an agreement was entered at Sunyani between them and Arkoh on behalf of the two artists to perform during lat year’s Christmas and a fee of ¢5 million was agreed upon.
Arkoh was said to have collected an initial deposit of ¢3.5 million for the artists.
However, on the day of the programme, only Kwabena Kwabena managed to arrive in Sunyani but he arrived too late for him to perform and the crowd who had earlier gathered waiting for their arrival before they paid their gate fee had already dispersed.
According to the affidavit, Arkoh agreed in a promissory note to pay the deposit plus the expenses incurred which amounted to ¢8 million.
In spite of several reminders, Arkoh had allegedly refused to pay the money, hence the suit.
In his reaction, Arkoh told The Spectator that the executives of the Junior Officers Mess, made him to sign the promissory note under duress.
He explained that the deposit he collected was given to Kwabena Kwabena who admitted before the executives that he had collected the money.
According to him, the soldiers picked him from his house on a different issue only to take him to the barracks to force him to sign the promissory note which he did to avoid being put behind bars.
